Abstract

The article proposes an interpretation of Cicero's De Divinatione as a social representation of divinatory practices that framed them in law’s symbolic efficacy.  Ciceron's work shows a symbolic structure in which public and private forms of divination are signified in their insertion into law, understood not only as a set of norms but as a series of statements with performative pretensions. The article compares Cicero's perspective on divination in De Legibus and De Divinatione, giving an account of a common symbolic structure.
